1. Agreement to these Terms
1.1 These Terms of Service (Terms) govern your access to and use of MyGuestWork, operated by My Guest Work Pty Ltd (ABN 38 698 315 187), trading as MyGuestWork (we, us or our).
1.2 By accessing or using MyGuestWork, you agree to these Terms. If you do not agree, you must not access or use MyGuestWork.
1.3 These Terms should be read together with our Privacy Policy, which forms part of your agreement with us.

3.1 MyGuestWork is an event guest management platform that helps Organisers manage guest lists, seating plans, QR code guest lookup pages, event pages, menus, floor plans, logos and related event materials.
3.2 Some features may only be available on certain plans, and some features may be introduced, changed or removed over time.
4. Who May Use MyGuestWork
4.1 You must be at least 18 years old to create an account, purchase a paid plan or use MyGuestWork on behalf of an organisation or client.

5. Accounts and Login
5.1 You are responsible for maintaining the security of your account and login access. MyGuestWork currently uses email-based authentication and one-time login codes. You must not share login codes or allow unauthorised people to access your account.
5.2 For individual plans, access is intended for the relevant account user. For workspace plans, workspace owners, admins, members and invited client users may access events according to the permissions available in the app.
5.3 You are responsible for activity that occurs through your account, workspace or event, except to the extent it results from our breach or fault, and you must notify us promptly if you believe your account has been accessed without permission.
6. Plans, Pricing and Payments
6.1 MyGuestWork offers a permanently free tier, one-time event upgrades and annual workspace Subscriptions. The features, inclusions and current prices of each plan are as shown at the point of purchase. The plans currently offered are described in this clause 6 and, for Subscriptions, in clause 7.
6.2 Free tier. A free tier is available permanently. It is subject to a limit of 50 guests and includes a limited set of features, as described at the point of sign-up.
6.3 One-time event upgrades. You may purchase a one-time upgrade for an individual event. These are once-off charges and do not recur. The upgrades currently offered are:
6.4 Annual workspace Subscriptions. Workspace Subscriptions are billed annually and include a set number of events each year. The plans currently offered are:
6.5 Additional event credits. If you hold an active paid workspace Subscription, you may purchase additional event credits at USD $89 / AUD $129 / GBP £79 per credit. Additional event credits are a one-time purchase, are non-refundable, and are not restored if an event is deleted.
6.6 Enterprise and custom plans. Enterprise or custom plans may be available on request. To enquire, contact us at hello@myguestwork.com.
6.7 Currency. The currency in which you are charged is determined automatically by your region (for example, United States in USD, Australia in AUD, and the United Kingdom in GBP). Other currencies may be offered from time to time.
6.8 Payment processing. Payments are processed by Stripe. We do not collect or store your full card number, CVC or bank account details. If a payment fails, your purchase may not be completed and you may be asked to try again.
6.9 We may change our plans, prices, inclusions and available currencies from time to time. For one-time purchases (including event upgrades and additional event credits), changes apply as stated at the time of purchase and do not change the price of a purchase you have already completed. For Subscriptions, clause 7 applies.
7. Subscriptions
7.1 This clause applies only where you purchase a workspace Subscription. Where you purchase one-time event access or additional event credits instead, this clause does not apply to that purchase.
7.2 Annual billing and automatic renewal. Workspace Subscriptions are billed annually in advance and renew automatically on the anniversary of the date you started the Subscription, until cancelled. By starting a Subscription, you authorise us, through Stripe, to charge the then-current annual Subscription fee to your nominated payment method on each renewal date. We will make the renewal frequency and price clear at the point of purchase.
7.3 Included events reset annually. The number of events included in your Subscription applies to each annual period and resets to zero at each annual renewal. Unused included events do not carry over to the next period.
7.4 Upgrades. If you upgrade your Subscription during a billing period, the upgrade takes effect immediately and is charged on a prorated basis for the remainder of the current billing period.
7.5 Downgrades. If you downgrade your Subscription, the downgrade is scheduled and takes effect at your next renewal date. Your existing plan continues until then.
7.6 Cancelling. You may cancel at any time. Cancellation is scheduled for the end of the current billing period, and your Subscription remains active until then. Unless required by law, no refund or prorated credit is issued on cancellation.
7.7 Failed payments. If a renewal or other Subscription payment fails, the Subscription is marked past-due but remains active while payment is pending. If payment is not resolved, we may suspend or limit access to paid features, subject to your rights under applicable law.
7.8 Changes to Subscription fees. We may change Subscription fees from time to time. We will give you at least [30] days' notice before a change takes effect. The change applies from your next renewal after the notice period, and you may cancel before then if you do not accept it.
7.9 Nothing in this clause limits your rights under the ACL.
8. Free Tier and Trials
8.1 Free tier. A free tier is available permanently. It is subject to a limit of 50 guests and includes a limited set of features. We may modify, limit or end the free tier at any time, subject to your rights under applicable law.
8.2 Free trial. A 14-day free trial is available to new users, with no payment required and no payment method needed to start it. The trial expires automatically at the end of the 14-day period and cannot be renewed. Unless we clearly state otherwise, trial access is intended for evaluation and testing and is not intended for live commercial events. If you wish to continue using paid features after the trial, you will need to purchase a plan.
9. Refunds and Cancellations
9.1 Your rights under the ACL come first. Nothing in these Terms (including this clause) excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or other applicable consumer protection laws that cannot be excluded. If our supply fails to meet a consumer guarantee, you may be entitled to a remedy under that law.
9.2 Subject to those rights, because access is generally supplied for a specific event, we are not required to provide a refund simply because you:
9.3 Subscription refunds are otherwise dealt with in clause 7. If you believe you are entitled to a refund or other remedy, including under the ACL, contact us using the details in clause 30 and we will consider your request.
10. Event Data and Guest Information
10.1 You are responsible for the event data and guest information you upload, enter, import, manage or display through MyGuestWork, including guest names, seating assignments, event details, menus, floor plans, logos, photos, videos, internal notes and other files.
10.2 You must have the right to collect, use, upload and display this information, and must ensure it is accurate and appropriate for your event. Our handling of personal information is described in our Privacy Policy.
11. Public Event Pages and QR Codes
11.1 MyGuestWork may let you create public event pages, QR codes and guest seat-finder pages, which may be accessible to anyone who has the URL or QR code without an account. You are responsible for:
11.2 We configure app routes and public guest pages to discourage search-engine indexing, but cannot guarantee how every search engine, browser or third party will treat a page. To the extent permitted by law, we are not responsible for access that occurs because you or someone else shared an event link or QR code publicly or with unintended recipients.
12. Guest Uploads and Event Media
12.1 Where photo or video upload features are available, Guests or Organisers may upload media. You are responsible for ensuring uploaded media is lawful and appropriate, and must not upload, permit or encourage the upload of content unless you have the necessary rights, permissions and consents, particularly where it includes Guests, children, private moments, venue staff, performers, or copyrighted or branded material.
12.2 We may remove, restrict or disable access to content if we reasonably believe it may breach these Terms, infringe rights, create legal risk, compromise privacy, or harm MyGuestWork or its users.
13. User Content Ownership and Licence
13.1 You retain ownership of content you upload to MyGuestWork.
13.2 By uploading, entering or submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, display and transmit it as reasonably necessary to provide, operate, support, secure and improve MyGuestWork. This licence ends when the content is deleted from our systems, subject to backup, legal, security, compliance or technical retention requirements.

16. Communications
16.1 MyGuestWork may send service-related, support, account, payment and transactional event-related emails.
16.2 Future features may allow Organisers to send RSVP or invitation messages (for example by email or messaging services such as WhatsApp) through MyGuestWork using third-party providers. If and when those features are available and you use them, you are responsible for ensuring you have permission or a lawful basis to contact Guests and that your use complies with applicable spam, privacy and marketing laws.
16.3 We do not send marketing emails to Guests. Account users may receive product or upgrade-related communications where permitted by law, and may unsubscribe from marketing communications where required, though service, security, payment and account emails may still be sent.
17. Third-Party Services
17.1 MyGuestWork relies on third-party services for hosting, authentication, database and file storage, payments, email delivery, analytics, error monitoring and development operations, which may include Supabase, Vercel, Stripe, Brevo, Sentry, Google Analytics, Microsoft Clarity, GitHub and others.
17.2 These services have their own terms and practices. To the extent permitted by law, we are not responsible for failures, outages, delays, data-handling practices or actions of third-party services.
18. Availability and Changes to the Service
18.1 We aim to keep MyGuestWork available and reliable, but do not guarantee it will be uninterrupted, error-free or available at all times, and we do not offer an uptime guarantee.
18.2 We may modify, suspend, limit or discontinue features where reasonably necessary, including for maintenance, security, legal compliance, product improvement, technical issues, provider changes or business reasons. Where practical, we will try to avoid unnecessary disruption to active events, but cannot guarantee uninterrupted access. This clause does not limit your rights under the ACL.
19. Support
19.1 You can contact support using the details in clause 30. Support is available 24/7 and we usually respond within 24 hours, but response times are not guaranteed. We do not currently offer phone support unless separately agreed.
20. Suspension and Termination
20.1 We may suspend, restrict or terminate your access if:
20.2 Where reasonably practical and lawful, we will give you notice before doing so. You may stop using MyGuestWork at any time. Termination does not affect rights or obligations that arose before it, and nothing in this clause limits your rights under the ACL.
21. Data Deletion
21.1 You may be able to delete events, guest data or uploaded files through the app, and may contact us using the details in clause 30 for assistance. Some information may be retained where required or permitted for legal, accounting, security, backup, dispute resolution or compliance purposes. Our handling of personal information is described in our Privacy Policy.
22. Intellectual Property
22.1 MyGuestWork, including our software, design, branding, website, app, logos, templates, workflows, text, graphics and other materials, is owned by us or our licensors.
22.2 You must not copy, reproduce, modify, distribute, sell, lease, exploit or create derivative works from MyGuestWork except as allowed by these Terms or with our written permission. You may use MyGuestWork only for your own events, client events or permitted business purposes in accordance with your plan.
23. Feedback
23.1 If you provide feedback, suggestions or ideas, you agree that we may use them without restriction or compensation to you. You are not required to provide feedback.
24. Disclaimers
24.1 To the maximum extent permitted by law, and subject to clause 25, MyGuestWork is provided on an "as is" and "as available" basis. To that extent, we do not guarantee that:
24.2 You are responsible for checking your event setup, guest list, seating assignments, QR codes and public pages before using them for a live event.
25. Australian Consumer Law and Non-Excludable Rights
25.1 Certain rights, guarantees and remedies cannot be excluded, restricted or modified under the laws that apply to you (non-excludable rights). These may include consumer guarantees under the ACL, and mandatory consumer, privacy or other rights that apply to you under the law of your country or region. Nothing in these Terms excludes, restricts or modifies any non-excludable right, and if any part of these Terms would do so, that part does not apply to you to that extent.
25.2 Where the ACL applies and the goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for failure to comply with a consumer guarantee is limited, to the extent permitted by law and at our option, to:

26. Limitation of Liability
26.1 The limitations in this clause are subject to clause 25 and apply only to the extent permitted by law. They do not limit any non-excludable right.
26.2 To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill, data, opportunity, reputation or business interruption, however arising.
26.3 To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with MyGuestWork or these Terms is limited to the greater of:
26.4 This does not apply to liability that cannot lawfully be limited, and does not limit our liability for our own fraud, wilful misconduct, or death or personal injury caused by our negligence to the extent that liability cannot be limited by law.
27. Indemnity
27.1 To the extent permitted by law, you agree to indemnify us and our officers, employees, contractors and agents against reasonable claims, losses, liabilities, damages, costs and expenses to the extent they arise from:
27.2 This indemnity does not apply to the extent the loss or claim was caused by our own breach, negligence or wilful misconduct, and is reduced to the extent our acts or omissions contributed to it.
28. Notices
28.1 Notices under these Terms must be in writing and in English and may be sent by email, to you at the address linked to your account, and to us using the details in clause 30.
28.2 Unless the sender knows or reasonably suspects the email was not delivered, a notice is taken to be given 24 hours after it is sent, or when replied to, whichever is earlier. If that time falls on a weekend or NSW public holiday, the notice is taken to be given on the next business day.
29. Records, Privacy and General
29.1 Records. To the extent permitted by law, we may keep records of transactions, account activity and communications made through MyGuestWork for administrative, security, dispute-resolution and compliance purposes, and may produce them where required in connection with a legal dispute.
29.2 Privacy. Our Privacy Policy explains how we collect, use, hold and disclose personal information in connection with MyGuestWork.
29.3 Governing law. These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them. Nothing in this clause limits any rights you have under the ACL or other applicable mandatory law in your jurisdiction.
29.4 Disputes. If you have a dispute, please contact us first using the details in clause 30 so we can try to resolve it in good faith before formal proceedings, except where urgent or interlocutory relief is required.
29.5 Severance. If any provision of these Terms is void or unenforceable, it is severed to that extent and the rest continues to apply.
29.6 Entire agreement. These Terms (with the Privacy Policy) are the entire agreement between you and us about MyGuestWork and supersede any prior understanding on that subject.
29.7 Waiver. Our failure to enforce a provision is not a waiver of it.
29.8 Assignment. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours in connection with a sale, restructure or transfer of our business.
29.9 Changes to these Terms. We may update these Terms from time to time. If we make material changes, we may notify users by updating this page, sending an email or displaying a notice in the app. The updated Terms apply from the date they are published unless stated otherwise. If you continue using MyGuestWork after they are updated, you accept the updated Terms; if you do not agree, you should stop using MyGuestWork.
